1. About Us

HIM ART GALLERY is an online store operated from India, specializing in original, handmade paintings created by the artist. Each artwork sold on this website is handmade and, unless stated otherwise, is a one-of-a-kind, original piece.

2. Eligibility

By using this website, you confirm that you are at least 18 years of age, or are using the site under the supervision of a parent or legal guardian.

3. Products

  • All paintings listed on this website are handmade. Minor variations in colour, texture, brushwork, and finish may occur due to the handmade nature of the artwork, lighting during photography, and display settings on different screens/devices. Such variations are not considered defects.
  • Unless specifically listed as a print or reproduction, all paintings are original, one-of-a-kind works — once sold, the exact same painting cannot be reproduced or restocked.
  • Product images are for representation purposes. Actual dimensions, framing, and colour may vary slightly from what is displayed.
  • We reserve the right to modify, discontinue, or update product listings, descriptions, and prices at any time without prior notice.

4. Pricing and Payment

  • All prices listed on the website are in Indian Rupees (INR) and are inclusive of applicable charges unless stated otherwise.
  • We currently sell only to customers within India.
  • At present, HIM ART GALLERY is not registered under GST due to turnover being below the applicable threshold. Invoices/receipts issued will reflect this accordingly. This may be updated in the future as our business grows, without affecting orders already placed.
  • Payments are processed through secure third-party payment gateway(s). We do not store your card, UPI, or banking details on our servers.
  • An order is considered confirmed only after successful payment and receipt of order confirmation from us.

5. Shipping

  • We currently ship only within India.
  • Estimated delivery timelines will be communicated at checkout or via order confirmation, and may vary based on your location, courier availability, and the size/fragility of the artwork.
  • Paintings are shipped framed and, where applicable, with glass. We take reasonable care in packaging fragile items, but please refer to our Return & Refund Policy for what to do if an item arrives damaged.
  • Risk of loss or damage in transit is addressed separately in our Return & Refund Policy, which forms part of these Terms.

6. Returns, Refunds, and Damage Claims

Our full Return & Refund Policy is available on our [Return & Refund Policy] page and forms part of these Terms & Conditions. By placing an order, you agree to the terms described there. In summary:

  • Change-of-mind returns are not accepted for original, handmade paintings.
  • Transit damage claims require a mandatory, unedited unboxing video and must be reported within 48 hours of delivery. Claims without a video or reported late may not be accepted.
  • For frame/glass damage, the original painting must be shipped back to us for re-framing, since no duplicate of a handmade artwork exists. This must be done using a trackable, insured courier, within 7 days of claim approval.
  • If the original painting is not returned, no refund will be issued. If it is returned but found damaged or altered, its cost will be deducted from the refund, with the final amount determined by HIM ART GALLERY at its discretion.
  • Very minor cosmetic damage may, at our discretion, be resolved with a partial refund without requiring the painting to be shipped back.
  • The typical turnaround for a frame/glass replacement claim is around 15 days.
  • Original shipping charges are non-refundable, except where the issue was caused by HIM ART GALLERY.
  • Risk in the artwork passes to the buyer upon delivery.
  • We are not responsible for loss or damage to a painting during return transit if sent through an unreliable or untracked method.

7. Custom/Commissioned Orders (if applicable)

Where we accept custom or commissioned painting requests, such orders are made specifically for the customer and are non-returnable and non-refundable once work has begun, except in cases of transit damage or error on our part, as covered in our Return & Refund Policy.

8. Intellectual Property

  • All artwork, images, website content, logos, and branding on this website are the intellectual property of HIM ART GALLERY and the artist, and are protected under applicable copyright and intellectual property laws.
  • Purchasing a painting transfers ownership of the physical artwork only. It does not transfer any copyright, reproduction rights, or commercial usage rights in the artwork unless explicitly agreed in writing.
  • You may not reproduce, copy, distribute, or use any images or content from this website for commercial purposes without our prior written consent.

9. User Conduct

You agree not to misuse this website, including but not limited to attempting unauthorized access, submitting false information, or using the site for any unlawful purpose.

10. Limitation of Liability

While we take care in the creation, packaging, and shipping of every artwork, HIM ART GALLERY shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or products, except as required under applicable Indian law.

11. Governing Law

These Terms & Conditions are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the jurisdiction of the courts located in Jodhpur, Rajasthan..

12. Changes to These Terms

We may update these Terms & Conditions from time to time. Any changes will be posted on this page with an updated “Last Updated” date. Continued use of the website after changes constitutes acceptance of the revised Terms.
